Their barrister argued that the inquiry's terms of reference are based on Letby's convictions, which are now potentially unstable as the Criminal Cases Review Commission (CCRC) investigates the case. They suggest the inquiry could be unfair and disregard serious issues if it continues without considering alternative explanations for the deaths. They have requested Health Secretary Wes Streeting suspend the inquiry until Letby's legal battle is resolved.
