La Cour supérieure met en garde Québec sur son projet de «Tribunal unifié de la famille»

Elle suggère au ministre de la Justice, Simon Jolin-Barrette, de soumettre son projet à la Cour d’appel.

The Quebec Superior Court warns Justice Minister Jolin-Barrette that his proposed "Unified Family Tribunal" (Bill 91) could complicate, rather than simplify, access to justice for families and may be unconstitutional. The Court suggests submitting the bill to the Court of Appeal for a constitutional review or reaching agreements with Ottawa. The Court argues the bill could increase fragmentation between the Superior Court and the Court of Quebec and proposes alternative solutions like a universal registry, shared access to files, and a special procedural track for cases involving youth protection or criminal charges.
