A motorcyclist, Thompson, who failed a roadside breath test after falling off his bike, is ordered to appear in Letterkenny District Court on March 28th. He is charged with being in charge of a mechanically propelled vehicle while exceeding the alcohol limit. His solicitor argues he had no intention of driving and was merely resting on the bike.
