‘You’ve got a willy, so you’re a man’ – Transgender case tribunal barrister

Barrister Naomi Cunningham said gender legislation had given her a ‘a good war’.



Barrister Naomi Cunningham, representing nurse Sandie Peggie in an employment tribunal against NHS Fife and Dr. Beth Upton, argued that "you've got a willy, so you're a man" in defense of Peggie's objection to sharing a changing room with a transgender doctor. Peggie was suspended after Dr. Upton alleged bullying and harassment following an incident in a female changing room. The case, which involves claims of sexual harassment and discrimination, has been adjourned until July and prompted a reminder about single-sex spaces from the Equality and Human Rights Commissioner. Cunningham stated that gender legislation has "reignited" her enthusiasm for law and that she is now "more and more determined to use real language in court".
