Rape trial shown footage of sexual encounter between complainant and a man not on trial
In a rape trial at the Central Criminal Court, jurors were shown CCTV footage of the complainant, a Spanish tourist, engaging in a sexual encounter with a man who is not the accused, in a B&B hallway hours after the alleged rape. The judge warned the jury the footage could be "intrusive" and "distressing," but said it was necessary to present it as evidence. The defense argued the footage undermined the complainant's reliability regarding her definition of rape, while the complainant maintained that the encounter in the footage was also rape, but "under coercion." The judge stated that the defendant has the right to have this evidence put before the jury. No charges have been brought against the second man.
